Forms of Payment

.   Online orders must be paid by credit card (VISA, MasterCard, Discover, American Express), PayPal, Hyatt's Gift Card or by previously established Hyatt's Charge Account.
.   Personal or company checks are accepted for telephone and fax orders, with shipments being released upon deposit.

Government Pricing
Equipment and supplies from some vendors are available on Federal GSA contracts, available to agencies of the Federal Government, as well as states and other government agencies. Items available from Gerber Scientific Products are on GSA contract # GS-25F-0008M and GS-35F-0046V. Hyatt's also accepts government credit cards for smaller purchases.

Hyatt's Charge Accounts
We welcome the opportunity to open new charge accounts for those credit worthy businesses, schools and organizations wishing to order on a continuing basis. To open a new account, we require a first order of $200 and the expectation that you plan to purchase $1000 or more annually. If your needs are less than this, we welcome your payment by check or major credit card. Charge account terms are net 30 days from the date of purchase. Unpaid invoices older than 45 days may cause delays in the filling of new orders and may cause the account to lose credit privileges. Charge account purchases must be at least $20.00. International Orders
VISA, MasterCard, Discover or American Express credit cards will be accepted for payment for Canadian orders. Orders for shipment outside the US and Canada must pay by PayPal. Our online ordering system will quote delivery charges and schedules for shipments outside the US to most international destinations, or you can call us at 1-800-234-9288 or e-mail us at mail@hyatts.com. Customs clearance and import duties are the responsibility of the recipient. Contact your local customs office for further information.

When ordering goods from Hyatt's to be delivered to addresses outside the United States and its Protectorates, shipments will be made to you only after you explicitly agree to become Importer of Record ("IOR") and as such customs clearance shall be made in your name and on your behalf. As IOR, you agree to be ultimately responsible for importing the products ordered by you into the destination country and are solely responsible for the payment of duties, and taxes either at the time of sale if prepayment is required by Hyatt's or at the time of importation if prepayment is not required. You hereby give a proxy or power of attorney ("POA") to the shipping provider designated by Hyatt's for the customs clearance of products ordered by you. This POA authorizes Hyatt's designated shipping provider's assigned customs broker to act on behalf of you. Hyatt's designated shipping provider's intervention with respect to customs formalities may be done by a customs agent assigned by Hyatt's designated shipping provider on your behalf. You hereby acknowledge to have understood the concept of IOR and the need of the POA and further state that the terms of the POA or terms of the purchase from Hyatt's and transportation conditions from Hyatt's designated shipping provider are not unreasonable or unknown to you, that you have read them, understood them and further have agreed to them.

Price Changes
Online prices are updated on a regular basis and accurately reflect online charges. Special promotions may be offered and will be honored only in the stated time frames.

.   Hyatt's discounts many items up to 70% below manufacturers' list prices everyday, including nearly all paints, brushes and canvas products.

.   Hyatt's Customer Appreciation Card program rewards our retail customers with a free $20 gift certificate after in-store purchases of $40 or more on 10 individual days.

.   Hyatt's discounts all Pantone books, kits and digital products below list price everyday.
.   Volume discounts are offered for orders of 40 or more Pantone replacement pages and textile swatches. Contact us by phone or e-mail for an individual quotation.

.   Hyatt's discounts many of our computer signmaking products through informal contracts for individual accounts. If you are interested in purchasing sign products from Hyatt's on a frequent basis, please contact us for a custom proposal. Hyatt's is committed to providing a safe and private shopping experience. We do not collect any personally identifying information when you visit our web site unless you choose to provide such information to us for specific purposes. Hyatt's does not sell or otherwise knowingly disclose personal information to any outside party for any reason.

Personal information that is collected during the ordering process is safely transmitted to our secure server. All transmissions are validated as secure by VeriSign. This information is for internal use only and is not shared, sold or disclosed to any outside party for any reason.

Product Availability
On occasion a product from our catalog or normal inventory will not be available to fill an order. Backordered items will be shipped as quickly as possible. Since shipping charges are based on the initial order's subtotal, no additional charges will be added for the shipping of backorders.

Refused Shipments
Shipments refused by a customer will be credited less shipping charges and a 20% restocking fee.

Returns
If you are unhappy with your purchase, call us at 1-800-234-9288 or e-mail us at mail@hyatts.com to discuss your situation. Requests must be made within 14 days of delivery, the products must still be in original packaging and be unused and undamaged. Books, magazines, Pantone products, portfolios/presentation books, projectors, lightboxes and special orders are not returnable. All returns are subject to a 20% restocking fee or $6.00, whichever is greater. Shipping charges cannot be refunded. Return shipping and insurance are the customer's responsibility. If your order arrived with any product missing or damaged, please refer to the Shortages & Damages section below.

Sales Taxes and Exemptions
All pricing is exclusive of applicable state and local sales taxes, which are the responsibility of the purchaser. Hyatt's is currently required to collect sales tax in more than 40 states. Sales tax shall be added to the order amount unless we are provided with a valid exemption certificate or if the purchaser is located outside the states in question.

Shipping Charges and Methods

.   Orders over $200 of regularly stocked items will be shipped free via Ground anywhere in the contiguous United States. This offer applies to all products that measure less than 22 x 32 inches. If orders over $200 of regularly stocked items include items that are temporarily out of stock, those will be shipped free after they arrive back in stock. If an item is out of stock and the customer requests drop shipment, they will be charged freight on the drop shipment.
.   Pantone Replacement Page or Cotton Swatch orders over $200 of regularly stocked items will be shipped free guaranteed two-day shipping anywhere in the contiguous United States. Orders less than $200 will incur a shipping charge of no more than $10.95 for two-day shipping if requested. Pantone backorders less than $200 will incur a charge for shipping.
.   Domestic ground will be sent UPS, USPS or FedEx Ground depending on your location and package size. Next day, Second Day and other service options are also available at additional expense.  Shipments outside the contiguous US are easily arranged to Alaska, Hawaii, US Territories, and most international destinations at additional expense.

.   Shipping charges are based on weight and package size, the method we feel is most fair to our customers. Our minimum shipping weight is 1 pound. Handling and insurance fees apply to all orders. Any additional services such as liftgate, notification, residential, etc. will be quoted at time of order and be the responsibility of the customer.

Shortages & Damages
Packing list discrepancies or product damages should be reported immediately. Damage to the outside packaging should be reported to the delivering carrier at the time of the delivery. If you were not present at the time of delivery, please contact us immediately and we will assist you .Interior damage, defective products or missing items must be reported within 5 days by phone at 1-800-234-9288 or by e-mail to mail@hyatts.com.

Warranties
Hyatt's offers many name brand products some of which carry a manufacturer's warranty. These limit obligations to the replacement of defective product for defects in material and workmanship. They do not warrant products for the intended application. Under no circumstances will Hyatt's be liable for loss, damage, expense or consequential damages of any kind, arising out of the use or inability to use the products listed here.

Sales to Other Retailers
Hyatt's is primarily in the business of selling art, drafting, framing, graphic and signmaking supplies to retail and commercial customers. Because of our large selection of products and our ability to buy at favorable prices, we frequently get requests from other retailers wishing to purchase from us for the purpose of resale. We are happy to accommodate these requests as long as the following requirements are met:

     (1)   The retailer must be located in an identifiable retail store open for business to the general public.
     (2)   The retailer must be making purchases for resale purposes, have a resale certificate and display a representative merchandise stock at all times.
     (3)   The first order with Hyatt's must be at least $200.00 net at wholesale prices. This order must be placed with the managers of our customer service departments at 1941 Elmwood Ave, Buffalo, New York by phone, fax, or in person by appointment. Payment must be made by cash, check or credit card. A Hyatt's charge account application may be submitted after the first order has been paid.
     (4)   Subsequent purchases may be made at any of our four retail stores during our regular store hours, or by telephone, fax or online. These orders must be at least $200.00 net if they are charged on a Hyatt's charge account. There is no minimum for orders when paid by cash, check or credit card.
     (5)   All sales to retailers ship FOB-Buffalo, NY or place of origin.
     (6)   Accounts with less than $1000.00 in purchases during a calendar year must be re-established with a new $200.00 opening order the following year.
     (7)   Retailer accounts do not qualify for various retail promotions made by Hyatt's, such as the Customer Appreciation Card, coupons, etc.
     (8)   Hyatt's reserves the right to limit quantities available for purchase at wholesale prices in order to maintain sufficient stock for our retail customers.
